Kentucky Supreme Court rules student was entitled to Miranda warnings before questioning by assistant principal in the presence of school resource officer

The Kentucky Supreme Court, in 4-3 split, rules that a high school student, who was detained in the school office for questioning by an assistant principal regarding giving prescription drugs to a classmate in the presence of a school resource officer, was entitled to Miranda warnings before the school official began the questioning, and therefore any incriminating statements elicited from the student are subject to suppression in a subsequent juvenile proceeding.

Arizona Gov. Janice Brewer has signed a law providing strong new restrictions on the use of so-called “seclusion rooms” in schools. Arizona joins more than 30 other states that impose rules on the restraint of students in public schools.

Supreme Court finds drug dog search on house porch to be an unreasonable search

The United States Supreme Court, in a 5-4 decision, held that use of a drug-sniffing dog by police officers on the front porch of a suspect’s home, without probable cause, a search warrant, or the homeowner’s consent, constituted an unreasonable search under the Fourth Amendment.

NRA unveils school safety recommendations

A National Rifle Association (NRA) task force has issued a report, in response to the Newtown, Connecticut school shooting, recommending the creation of programs that give additional weapons training to school resource officers as well as “selected and designated school personnel” who could then carry arms.
