North Carolina parents sue district for strip-search of elementary student for missing $20

The Fayette Observer reports that Clarinda and Lionel Shawn Cox, the parents of Justin Cox, have filed suit in federal court against the Sampson County Board of Education, alleging their then-fifth grade son was strip-searched in June 2012 by now-former Union Elementary School Assistant Principal Teresa Holmes for $20 reported missing in the school’s cafeteria.

Jury rejects teacher’s claim that California district failed to accommodate his diabetes

The Palo Alto Daily News reports that after brief deliberations, a San Mateo County civil jury returned a verdict rejecting Manuel Delgado’s claim that the Sequoia Union High School District refused to provide him with accommodations for his diabetes and anxiety disorder.

Federal appellate court finds no First Amendment violation for dismissal of public employee for political affiliation

A three-judge panel of the United States Court of Appeals for the Seventh Circuit has upheld the district court’s grant of summary judgment in favor of Calumet City, finding no First Amendment violation for the dismissal of Jay Embry, a public employee who claimed retaliation after backing the “wrong” candidate, because he held a policy-making position and could be removed from office solely for his political affiliation.

Federal appellate court hears arguments in suit by Mississippi student challenging suspension for online video accusing coaches of sexual misconduct with female students

The Associated Press reports in the Sun Herald that a three-judge panel of the U.S. Court of Appeals for the Fifth Circuit has heard arguments in a suit over the suspension of a student from a Mississippi school district for posting online a rap song he recorded that accused two coaches of misconduct with female students.

Kansas appellate court upholds constitutionality of state law criminalizing sexual relations between teacher and student enrolled at the same school

The Kansas Court of Appeals has ruled that a state law making it a crime for a teacher to engage in sexual relations with a student enrolled at the school where the teacher is employed does not unconstitutional.

Principals’ union sues Maryland district for $100M for discrimination

According to Gazette.Net, the Association of Supervisory and Administrative School Personnel has filed a federal class action suit against the Prince Georges County School Board and former Superintendent William Hite on behalf of the county public school system’s principals and administrators, charging they were fired or demoted under Hite due to age and race discrimination.

Idaho voters reject state superintendent’s education reforms

According to an Associated Press report in Seattle’s Pilot Intelligencer, voters in Idaho rejected all three of Superintendent of Public Instruction Tom Luna’s education reforms. Luna’s plan to spend $180 million to lease laptops for high school students and create online-class mandates was turned down by 2/3 of voters. They also voted against his proposals to limit teachers’ collective bargaining rights and merit pay for teachers.

EEOC issues Q&A guidance for application of Title VII and ADA in cases of domestic or dating violence, sexual assault, or stalking

The Equal Employment Opportunity Commission has recently released a guidance document, “Questions and Answers: The Application of Title VII and the ADA to Applicants and Employees Who Experience Domestic or Dating Violence, Sexual Assault, or Stalking,” to assist employers in processing applicant and employee matters involving these situations.

Oregon district considers social media policy designed to limit after-hours teacher-student communications

The Albany Democrat-Herald reports that Sweet Home School District’s school board is considering a proposed policy meant to tighten controls on after-hours communication between teachers and students that has prompted free speech concerns.
