California appellate court rules that district can use norming ratios to determine classroom space for charter schools

The California Court of Appeals, Second Appellate District, has ruled that the Los Angeles Unified School District did not violate Prop 39, which requires public school districts to share their facilities fairly among all public school pupils, including those in charter schools, when it used norming ratios to determine appropriate classroom space for charter schools.

Texas school districts can obtain waivers from state law limiting classroom size based on financial hardship

According to a Dallas Morning News article in Education Week, financially stressed school districts in Texas will find it easier to get exempted from the 22-student class size limit this year under a new state provision that allows districts to get class size waivers because of “financial hardship.”

Over half of Florida’s school districts risk fines for violating class size law

According to an Associated Press report in the Miami Herald, over half of Florida’s 67 school districts could face fines for violating state class size limits. State education commissioner Eric Smith notified 35 districts and three laboratory schools that they were out of compliance. Statewide, 44,556 of 812,483 traditional public classrooms, or 5.5%, had too many students. Also, 44 of 454 charter schools were in violation. Potential fine amounts have not yet been calculated but they could run into the millions for larger districts.

Florida ballot measure to relax class size requirements fails

A ballot measure that would have scaled back some of the strictest requirements of Florida’s class-size amendment approved by voters in 2002 failed in the November, 2010 general election. Fifty-five percent of voters voted in favor of the measure, but 60 percent of the vote was required for passage.

Teachers union sues school district over plan to increase class size

The Chicago Sun-Times reports that Chicago Teachers Union (CTU) officials are suing the City of Chicago Board of Education (CCBOE) claiming that the board’s plans to increase class sizes to 35 would create an unsafe learning environment for students and teachers.
