According to reports from The Republic, a former English-language learner specialist, who is an African from Cameroon, has filed suit against Gilbert Public Schools alleging discrimination on the basis of race and national origin.

Ohio federal court dismisses peer bullying/harassment suit against district in student suicide case

An Ohio federal district court has granted a school district’s motion for summary judgment in a suit brought by the parents of a high school student who committed suicide, claiming that the student was repeatedly subjected to peer bullying and harassment in violation of her Fourteenth Amendment substantive and procedural due process rights, Fourteenth Amendment equal protection rights, Title VI and Title IX rights, and under Section 1983 related to a municipal liability claim based on the failure to train.

DOJ enters settlement agreement with Georgia district to ensure enrollment of ELL students

In a press release, the U.S. Department of Justice and the Henry County School District have entered into a settlement agreement to ensure that all students in the district are able to enroll in school, regardless of national origin or immigration status.

North Carolina district agrees to policy changes after civil rights group files federal complaint on behalf of Latino students

The Associated Press (AP) reports in the Record that Durham school district has agreed to changes in policies affecting Latino students and parents to resolve a complaint against it by the Southern Poverty Law Center (SPLC). The school district will strengthen its existing anti-discrimination policy, provide parental notifications and other documents in the native language of a student’s parents and provide interpreters for parents with limited English skills in understanding school policies, among other changes.

Hispanic student’s suit accuses California school district of racial discrimination

The Big Bear Grizzly reports that Bear Valley Unified School District (BVUSD), the school board, a teacher, principal and interim superintendent of schools have been sued for allegedly violating a Hispanic students rights under the Civil Rights Act of 1964 and the Equal Protection Clause of the Fourteenth Amendment. The suit was filed by the Mexican American Legal Defense and Educational Fund (MALDEF) on behalf of Coral Aviles, who claims she was harassed publicly and suffered racial discrimination in 2010 by a teacher at Big Bear Middle School.

OCR issues guidance as part of anti-bullying initiative

The U.S. Department of Education’s Office for Civil Rights (OCR) has issued guidance in the form of a dear colleague letter to to schools, colleges and universities throughout the nation to remind educators that some student misconduct that falls under a school’s anti-bullying policy also may trigger responsibilities under one or more of the federal anti-discrimination laws enforced by OCR. The guidance warns schools that “by limiting its response to a specific application of its anti-bullying disciplinary policy, a school may fail to properly consider whether the student misconduct also results in discriminatory harassment.”
