Colorado appellate court rules parents/taxpayers have no standing to challenge district’s private school voucher program

In a 2-1 split, a three-judge panel of the Colorado Court of Appeals has ruled that the plaintiffs, who include students, parents, taxpayers, and non-profit organizations, lacked standing to challenge the Douglas County School District’s Choice Scholarship Program, which provides vouchers for private school tuition under Colorado’s Public School Finance Act of 1994.

Federal appellate court denies Louisiana school district’s request to dismiss suit challenging single-sex classes on the grounds of standing or mootness

A three-judge panel of the U.S. Court of Appeals for the Fifth Circuit has denied a school district’s motion to dismiss a parent’s suit on behalf of her daughter challenging the school’s single-sex classroom program on the basis of Title IX and the Equal Protection Clause on the grounds the parent lacks standing to bring the suit or the claims are moot. The panel remanded the case to the federal district court to determine if the student has a personal stake in resolution of the request for injunctive relief applicable to future class years until the issues on the merits are resolved.

Employee alleging dismissal in retaliation for his fiancee’s Title VII complaint has his own Title VII claim against their shared employer

In an 8-0 vote, the U.S. Supreme Court has ruled that an employee who was terminated after his fiancee, who formerly worked for the same employer, filed a sex discrimination complaint against the employer with the federal Equal Employment Opportunity Commission (EEOC), had a valid claim for retaliation against the employer under Title VII. Justice Kagan took no part in the consideration or decision of the case.

Teachers have standing under Michigan Constitution to sue school board for failure to comply with statutory duty to expel students who have assaulted a teacher

The Michigan Supreme Court has ruled 4-3 that teachers who were allegedly physically assaulted by students have standing to bring suit against the school board for failure to comply with its statutory duty to expel those students.
