Alabama takeover of local district challenged on grounds it violates federal Voting Rights Act

WBRC Fox 6 reports that the Alabama Education Association has filed suit in federal court against state Superintendent Tommy Bice, Ed Richardson, Chief Financial Officer of Birmingham City Schools, and the Alabama Department of Education alleging voters in the city of Birmingham have been disenfranchised by the state takeover of the city’s school system.

New Mexico Education Secretary suspends local school board

As reported in the Los Angeles Times, New Mexico Education Department Secretary Hanna Skandera recently suspended the entire school board of the Questa Independent School District in northern New Mexico, saying that state officials would take over the running of the board.

Arizona settles federal government complaint over identifying students as English language learners

The Republic reports the Arizona Department of Education has settled a complaint brought by the U.S. Departments of Justice and Education as a result of an investigation that revealed that tens of thousands of students were incorrectly identified as being fluent in English.

Civil rights groups file special education suit against Mississippi Department of Education

According to an Associated Press report in The Republic, the Southern Poverty Law Center, Southern Disability Law Center, and Disability Rights Mississippi have filed suit in federal court against the Mississippi Department of Education, alleging that MDE has not done enough to solve special education problems in Jackson Public Schools.

According to a report from Associated Press (AP) in the Bowling Green Daily News, Kentucky education officials are acting to limit the use of restraint and seclusion on public school students after citing two schools for violating the rights of three disabled students who were subjected to the practices.

Pennsylvania district files suit against state seeking emergency funding to continue operating

Courthouse News Service reports that Chester Upland School District (CUSD) has filed suit against the state of Pennsylvania seeking a temporary restraining order (TRO) directing the state to give it at least $7 million in emergency funding to assure that it can continue operating for the next 6 weeks [through mid-February, 2012]. Without that order, the district said, it would be unable to make payroll starting the week of January 16.

Maine Dept. of Ed. drafts new rules on use of restraints and seclusion on students in public schools

The Maine Department Education (MDE) has released a draft of its new rules governing the use of restraint and seclusion on students in public schools, reports the Bangor Daily News. Some children’s rights advocates have expressed concern about the definition of restraint and the process laid out for secluding a student from others.
