New Jersey appellate court upholds district’s removal of teacher who posted derogatory remarks about her students on Facebook

A two-judge panel of the Appellate Division of the New Jersey Superior Court has ruled that school district officials were justified in terminating an elementary school teacher for posting derogatory remarks on Facebook about her students, including referring to them as “future criminals.”

The Associated Press reports in the Sun Herald that a three-judge panel of the U.S. Court of Appeals for the Fifth Circuit has heard arguments in a suit over the suspension of a student from a Mississippi school district for posting online a rap song he recorded that accused two coaches of misconduct with female students.

Kansas appellate court upholds constitutionality of state law criminalizing sexual relations between teacher and student enrolled at the same school

The Kansas Court of Appeals has ruled that a state law making it a crime for a teacher to engage in sexual relations with a student enrolled at the school where the teacher is employed does not unconstitutional.

Federal appellate court rules Wisconsin district is not liable for Title IX teacher-on-student sexual harassment

A three-judge panel of the U.S. Court of Appeals for the Seventh Circuit has ruled that a school district is not liable under Title IX for teacher-on-student sexual harassment because teachers’ alerts to a school administrator of their suspicion that a female co-worker had an inappropriate relationship with a student did not constitute actual notice of sexual harassment.

Illinois Supreme Court rules that former district owes duty of care to provide hiring district with accurate employment information

In a 5-2 split, the Illinois Supreme Court has ruled that two students, who were sexually abused by a teacher, had stated a valid cause of action against the school district that previously employed that teacher based on its duty of care to the students to provide a second district with a factually accurate employment verification form.
