Federal appellate court rules disabled student failed to state a claim for peer sexual harassment under § 504, has valid claim under § 504 for district’s refusal to make reasonable safety accommodations to IEP

The Fifth Circuit Court of Appeals has ruled that a disabled student stated a valid §504 claim that the school district committed gross misjudgment in failing to modify her IEP to safeguard her after three incidents of alleged sexual abuse by students, but failed to state a claim against the district for liability based on student-on-student sexual harassment.

Federal appellate court rejects teacher’s retaliation suit based on removal as coach

A three-judge panel of the U.S. Court of Appeals for the Sixth Circuit has affirmed a federal district court’s decision granting summary judgment in favor of a school district in a suit brought by a teacher/athletic coach claiming she was dismissed as the girls varsity basketball coach and suffered other acts of harassment in retaliation for having previously brought a Title VII sex discrimination suit in regard to the boys varsity basketball coaching position.

Connecticut federal court rules cheerleading not a sport under Title IX

ABCNews.com reports that a U.S. District Court judge in Connecticut has again ruled that competitive cheerleading, despite some upgrades, is not a sport, and says Quinnipiac University must remain under an injunction that requires the school to keep its women’s volleyball team.

Ohio federal court dismisses peer bullying/harassment suit against district in student suicide case

An Ohio federal district court has granted a school district’s motion for summary judgment in a suit brought by the parents of a high school student who committed suicide, claiming that the student was repeatedly subjected to peer bullying and harassment in violation of her Fourteenth Amendment substantive and procedural due process rights, Fourteenth Amendment equal protection rights, Title VI and Title IX rights, and under Section 1983 related to a municipal liability claim based on the failure to train.

Consent decree in Title IX suit over disparities in scheduling girls’ basketball games sets legal precedent in Seventh Circuit

The Associated Press reports in The Republic that a federal judge in Indiana has signed a consent decree between the Franklin County Community School Corp., former girls basketball coach Amber Parker, and nine of its opponent schools which calls for girls’ and boys’ games to be scheduled equally by the 2016-17 school year, with interim steps until then.

Fathers of two softball players file Title IX class action suit against Oregon district

The Oregonian reports that the fathers of two Seaside High School softball players have filed a class action lawsuit against Seaside School District 10, alleging that their daughters, and more than 250 other female students, have been denied and deterred from fully participating in team sports at the high school.
