ABCNews.com reports that a U.S. District Court judge in Connecticut has again ruled that competitive cheerleading, despite some upgrades, is not a sport, and says Quinnipiac University must remain under an injunction that requires the school to keep its women’s volleyball team.

California district’s bid for Race to the Top funds fails after teachers’ union withholds its support

The Los Angeles Times reports that efforts by the Los Angeles Unified School District to secure a $40 million grant through the Race to the Top competition funded by the U.S. Department of Education has failed, because the L.A. teachers’ union has declined to sign the application, a condition for the competition imposed by ED.

U.S. Departments of Education and Justice investigate Louisiana district for claims of discrimination against Latino students

The Times-Picayune reports that in following up on a complaint by the Southern Poverty Law Center, the U.S. Departments of Education and Justice will be investigating whether the Jefferson Parish school system discriminates against its Latino students.

New Jersey district enters resolution agreement with OCR in disability discrimination case

As reported in a press release on ed.gov, the U.S. Department of Education’s Office for Civil Rights has entered into a resolution agreement with the East Orange School District in New Jersey to resolve compliance concerns identified by OCR, under Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act of 1990, during its investigation of the district’s special education program.

NAACP’s federal complaint claims entrance exam for New York City’s elite schools is racially discriminatory

Reuters reports in the Huffington Post that the NAACP has lodged a complaint with the U.S. Department of Education charging that the admissions test for New York City’s specialized high schools discriminates against African-American and Latino students.

Federal court enjoins district from operating single-sex classes at West Virginia middle school

A federal district court in West Virginia has issued a preliminary injunction barring a school district from operating single-sex classes at one of its middle schools unless and until any single-sex program meets the requirements of the U.S. Constitution and Title IX.

U.S. Senate Committee holds hearing on use of restraint and seclusion of students

The Associated Press reports in The Washington Post that the Senate Committee on Health, Education, Labor and Pensions recently convened a hearing on the use of restraint and seclusion to raise awareness of how much physical force is used when disciplining students.
